Effective date: 1.2.2025

These Terms & Conditions govern the contractual relationship between Bc. Marek Kotyza, Business ID (IČO): 75084431, registered office Matějkova 1935/12, 190 00 Prague, Czech Republic, email info@tourguidematch.com, hereinafter referred to as the “Provider”, and the customer, hereinafter referred to as the “Customer”. By purchasing, accessing or using any product or service, the Customer agrees to these Terms.

  1. Scope of services
The Provider offers digital travel products including self guided itineraries, audio guides and related digital content, as well as third party services such as tours, tickets and activities provided by external suppliers. The Provider may act as a direct provider, reseller, intermediary or distributor depending on the product.
  2. Contractual relationship
For own digital products, a contract is concluded between the Provider and the Customer.
For third party services, a contract is concluded between the Customer and the respective supplier.
The Provider may act solely as an intermediary and is not responsible for the execution of third party services. The identity of the supplier is displayed on the product page or in the booking confirmation.
  3. Nature of digital products
Digital products are self guided experiences unless explicitly stated otherwise. They do not include a live guide, fixed schedule or personal assistance. The content is provided for informational and experiential purposes and may vary depending on conditions and user preferences.
  4. Bookings and payment
All bookings are made online and full payment is required at the time of booking. A confirmation email or voucher constitutes proof of booking. The Provider reserves the right to cancel a booking due to technical error, overbooking or supplier issues and may offer an alternative or a refund. System logs, access records, QR scans or activation data may be used as evidence in case of disputes or chargebacks. The Customer is responsible for providing a valid email address and ensuring delivery.
  5. Pricing and taxation
Prices displayed at checkout are final and may include service fees, commissions and margins. Prices may differ from supplier base prices and may vary across channels. Such differences do not constitute grounds for complaint or refund. The Provider is not a VAT payer unless stated otherwise. Tax obligations related to third party services are handled by the respective supplier where applicable.
  6. Delivery and service performance
Digital products are considered delivered at the moment when access is provided via link, QR code, voucher or access code, or when the Customer first accesses the content. By completing the purchase, the Customer explicitly requests immediate delivery and acknowledges that the service is fully performed upon access. The Customer therefore waives any right to withdraw from the contract once access has been granted to the maximum extent permitted by law.
  7. Use restrictions and intellectual property
All content is protected by intellectual property rights and remains the property of the Provider. The Customer receives a limited, non exclusive, non transferable license for personal use only. Any copying, sharing, resale or unauthorized distribution is prohibited. The Provider may monitor usage and revoke access in case of misuse without refund.
  8. Cancellation and refunds
Unless stated otherwise, digital products are non refundable once delivered or accessed. For third party services, cancellation and refund conditions are determined by the supplier and may override general rules. In case of no show, late arrival or partial use, no refund shall be provided. Any use of the service is considered full consumption.
  9. Changes and availability
The Provider or supplier may modify content, schedules or availability at any time. In case of significant changes or cancellations, the Customer may receive an alternative or refund at the Provider’s discretion or according to supplier policy. The Provider does not guarantee continuous availability of all content or locations.
  10. Third party services disclaimer
The Provider does not control third party services and is not responsible for their execution, quality or availability. All complaints related to third party services must be addressed to the supplier.
  11. Customer responsibility
The Customer is responsible for providing accurate information, complying with local laws, safety rules and instructions, and ensuring personal suitability for participation. The Customer making the booking acts on behalf of all participants and is responsible for informing them of these Terms.
  12. Technical requirements
The Customer is responsible for having a compatible device, internet connection where required, sufficient battery and necessary equipment. The Provider is not responsible for limitations caused by customer devices or settings.
  13. Liability limitation
To the maximum extent permitted by law, the Provider shall not be liable for any injury, loss, damage, delay, missed entry, missed transport, loss of enjoyment or indirect or consequential damages. Total liability of the Provider shall not exceed the amount paid for the booking. For third party services, liability is limited to the amount actually received by the Provider.
  14. Fraud and misuse
The Provider reserves the right to cancel suspicious bookings, refuse service, request identity verification or block access in case of suspected fraud, misuse or abnormal activity. In case of unjustified chargebacks, the Provider reserves the right to provide evidence and recover damages.
  15. Force majeure
The Provider shall not be liable for failure or delay caused by events beyond reasonable control including natural disasters, pandemics, government actions, technical failures, conflicts or travel restrictions. Services may be modified or cancelled without liability beyond applicable refund rules.
  16. Complaints and claims
Complaints must be submitted via email to info@tourguidematch.com including booking reference and description of the issue. The Provider will respond within a reasonable timeframe. For third party services, resolution depends on supplier cooperation.
  17. Refund processing
Approved refunds are processed using the original payment method within a reasonable timeframe. The Provider is not responsible for delays caused by banks, payment providers or suppliers.
  18. Technical dependency disclaimer
The Provider relies on third party systems including booking platforms, payment gateways and applications and is not responsible for their outages or technical issues.
  19. Language
These Terms are drafted in English. In case of translation, the English version prevails.
  20. Final provisions
These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by Czech courts unless mandatory consumer protection rules state otherwise. If any provision is invalid, the remaining provisions remain effective. The Provider reserves the right to update these Terms. The version valid at the time of purchase applies. By completing a booking, the Customer confirms acceptance of these Terms.
